Terms and Conditions

Welcome to TypingFlash. These Terms and Conditions ("Terms") govern your access to and use of our website, application, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

These Terms form a binding agreement. Sections on disclaimers, limitation of liability, and dispute resolution limit our obligations and your remedies. If you do not agree, do not use the Service.

1. Definitions

  • Service โ€” the TypingFlash platform, including the web app, typing tests, lessons, games, challenges, and related support.
  • User Content โ€” any content you create or submit (e.g. typing results, progress data, profile information).
  • Account โ€” the account you create to access the Service.

2. Eligibility and account

You must be at least 13 years old (or the age of consent in your jurisdiction) and able to form a binding contract. By using the Service, you represent that you meet these requirements.

You are responsible for:

  • Providing accurate registration information and keeping it up to date.
  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account. You must notify us promptly of any unauthorized use.

3. Description of the Service

TypingFlash provides a web-based typing practice platform that allows you to:

  • Take typing tests to measure speed and accuracy.
  • Complete typing lessons and practice exercises.
  • Participate in typing games and challenges.
  • Track your progress, earn awards, and obtain certificates.
  • Compete on the leaderboard and view your rankings.

We may change, suspend, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Violate any applicable law, regulation, or third-party rights.
  • Attempt to gain unauthorized access to our systems, other accounts, or data.
  • Use automated means (e.g. bots, scripts) to access or manipulate the Service.
  • Resell, sublicense, or commercially exploit the Service in a way not permitted by us.
  • Use the Service to harass, abuse, or harm others.
  • Interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate your access if we reasonably believe you have violated these terms or for other legitimate reasons (e.g. security, abuse).

5. User content and license

Ownership: You retain ownership of User Content you submit. We do not claim ownership of your typing results or progress data.

License to us: By using the Service, you grant TypingFlash a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content as necessary to:

  • Provide and operate the Service (e.g. store results, display progress).
  • Improve our services (e.g. in aggregated or anonymized form where applicable).
  • Comply with law and enforce our policies.

Responsibility: You are solely responsible for User Content. We may remove content that we believe violates these Terms or the law.

6. Subscription and payment

Certain features may require a paid subscription. If you subscribe:

  • Fees and billing terms will be shown at the time of purchase. You authorize us (or our payment processor) to charge your payment method for the selected plan.
  • Fees are generally non-refundable unless required by law or as stated in the offer.
  • We may change plan pricing for future purchases with advance notice; existing paid access periods are not automatically renewed at a new price.
  • Current Pro access is sold as a fixed 1-year period and does not renew automatically. After the paid period ends, access expires unless you manually purchase Pro again.

7. Intellectual property

The Service (including design, code, branding, and materials we provide) is owned by TypingFlash or our licensors. You may not copy, modify, distribute, or create derivative works from the Service except as permitted in these Terms or with our written consent. "TypingFlash" and related marks are our trademarks.

8. Disclaimers

Important

The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of liability

Important

To the maximum extent permitted by law, TypingFlash and its affiliates, officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless TypingFlash and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time; you may also request account deletion through the app or by contacting us.

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification, dispute resolution) will survive termination.

12. Disputes and governing law

These Terms are governed by the laws of the jurisdiction in which TypingFlash operates (e.g. the laws of the United States or the state of our principal place of business), without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of that jurisdiction, as specified in the version of the Terms in effect at the time of the dispute. You waive any right to participate in class actions where permitted by law.

13. Changes to the Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through the Service. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and may close your account.

14. General

  • Entire agreement: These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and TypingFlash regarding the Service.
  • Severability: If any provision is held invalid, the remaining provisions remain in effect.
  • No waiver: Our failure to enforce any right or provision does not waive that right or provision.
  • Assignment: You may not assign these Terms without our consent; we may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
